Terms of Service

PLEASE READ THE TERMS OF USE CAREFULLY

BY BEGINNING TO USE THE SERVICE, YOU ACKNOWLEDGE AND AGREE THAT YOU HAVE READ, UNDERSTOOD AND AGREE TO BE BOUND BY THE FOLLOWING TERMS AND CONDITIONS REFERRED TO (COLLECTIVELY THE “AGREEMENT”). IF YOU DO NOT AGREE TO THE TERMS, YOU ARE NOT AUTHORIZED TO USE THE SERVICE.


1 - Introduction

We are PT Assistance ehf., a company incorporated and operated under the laws of Iceland, with our registered office at Hafnarstræti, 600 Akureyri, Iceland (“we”, “us” or “PT”). We are registered for value added tax under VAT number 135912.

We offer a platform called PT Assistance (hereinafter the “Platform” and with all related services together the “Service”), which is a web and mobile solution that enables professionals to work with their clients over the internet by sending them exercise programs. You may not use the Service for any other purpose. You are solely responsible for all information, images, videos or other content that you provide or upload to the Platform.

We advise you to read these terms and conditions carefully so that you are aware of your rights and obligations when using PT's services. Inquiries can be sent to info@ptassistance.com.

2 - General provisions

A subscription gives the subscriber access to the training platform they choose to pay for.

Subscriptions must be cancelled by the 26th of each month, and cancellation will take effect from the end of the following month. If cancellation is received after that time, it will take effect from the end of the following month after receipt.

Cancellations must be sent by email to info@ptassistance.com. Responsibility for receipt and correct registration lies with the subscriber.

The subscriber shall pay a monthly fee according to the current PT price list. The price list may change during the contract period. The due date of invoices is the 8th of each month and the final date is 5–6 days before that (variable if it falls on a weekend or holiday). If the invoice has not been paid by the final date, late payment interest is calculated from the due date according to Chapter III of Act No. 38/2001.

If a subscriber has comments on an invoice, they must be made without delay and no later than the due date. Otherwise, the invoice is deemed approved.

If a direct debit to a payment card is requested, a payment slip is not issued, but the request is sent electronically to the subscriber's online bank according to PT's price list.

PT complies with the general terms and conditions of payment card services regarding the handling of card information, but the provisions of PT's privacy policy also apply, which is considered an integral part of these terms and conditions.

PT reserves the right to change or supplement these Terms at any time by posting an updated version on the Website. The changed Terms will be announced via email and a notice on the Website before they become effective. By continuing to use the Website, you irrevocably agree to the new Terms.

 

3 - Services and accessibility

The platform is accessible through the website Homepage - . To access the service, you must register an account.

Assuming you comply with all terms here, PT grants you a limited, personal, revocable, non-transferable license to use the Service.

PT will use its best efforts to provide the Service. You agree that the Service is provided “as is” and “as available”. PT does not warrant that the Service will always be available or error-free. PT is not responsible for services outside its control, including the Internet.

 

PT may at any time:

  • implement changes on the field;
  • temporarily restrict service due to maintenance or other reasons. We will notify you of this as soon as possible.

 

4 - User responsibilities

You may not:

  • upload material that PT considers offensive, derogatory or inappropriate;
  • handle personal data in a manner inconsistent with the law;
  • upload content that contains viruses or malicious software;
  • sending spam;
  • upload content that harms the interests of PT.

PT may remove content without notice if it violates the above.

Violations of this article may result in account closure and PT may be required to pay damages.

5 - Warranty

To the extent permitted by law, PT is not liable for damages related to:

  • your use of the Service;
  • your decisions based on the content of the Service;
  • errors in the service;
  • violations of the law by other users.

To make a claim, you must notify PT within three weeks of becoming aware of the event.

Nothing in these Terms limits liability for:

  • death or personal injury caused by negligence;
  • fraud;
  • other things for which liability may not be legally limited.

 

6 - Information on the service

We do not guarantee that information on the Service is accurate or appropriate. You are responsible for its use.

Exercises are for illustrative purposes only. Healthcare professionals are responsible for their use with their clients.

PT does not endorse any content on the platform. The Service may contain links to other websites. PT is not responsible for them or their content.

 

7 - Disclaimers and indemnifications

 

PT does not guarantee:

  • that the service is always accessible;
  • that its use has predetermined results;
  • that the information is correct or complete.

 

PT is not responsible for:

  • purchasing or operating your own equipment;
  • damage to material;
  • errors in data transmission;
  • unauthorized use of the service;
  • data backup;
  • management of use of the service.

PT may provide application programming interfaces for integration with other services but is not responsible for them.
